Thank you for choosing Maileditor LTD. Please review these Terms of Use (the "Terms") carefully. By accessing the Website or using the Service, you accept these Terms in full. If you do not agree, discontinue use immediately.

The following terms are defined for clarity throughout this document:

  • Service - The email template editor available on the Website or as a Plugin.
  • User - Any individual or entity that registers for an Account or interacts with the Service.
  • Account - A personal profile storing the User's details for Service access.
  • Access Credentials - The username and password used to access the Service.
  • Affiliates - Entities directly or indirectly controlled by or under common control with Maileditor LTD.
  • Agreement - These Terms governing Service use.
  • Harmful Code - Malware, viruses, or unauthorized software designed to compromise security.
  • Intellectual Property - Copyrights, patents, trademarks, domain names, and proprietary rights.
  • Hosted Content - Digital assets stored and delivered via the Service.
  • Subscription Fees - Recurring charges for paid Service plans.
  • Total Fees - Subscription Fees plus any additional applicable charges.
  • Send Test - A feature for sending test emails to preview content and formatting.

3. User Requirements & Account Creation

To use the Service, you must:

  • Be at least 18 years old and legally capable of entering into this Agreement.
  • Complete registration and provide accurate, up-to-date information.
  • Accept these Terms and the Privacy Policy unconditionally.

Restricted Users

You may not use the Service if you:

  • Promote or engage in violence, hate speech, or extremist ideologies.
  • Are affiliated with or publicly endorse restricted organizations.
  • Exhibit rudeness, aggression, or disrespect towards Maileditor LTD staff.
  • Engage in financial scams, get-rich-quick schemes, unlicensed software distribution, pornography, gambling, or other high-risk activities deemed inappropriate by the Company.

Non-compliance may result in denial of Service or Account termination.

4. Account Management & Security

Users are responsible for:

  • Maintaining the confidentiality of their login credentials.
  • All actions taken through their Account.
  • Using unique email and social media details for registration.

Maileditor LTD does not store active passwords and provides only password recovery instructions. Users must not request access to accounts they do not own.

5. Dispute Resolution & Data Protection

  • In the event of disputes, the Company may suspend accounts until resolution.
  • Account ownership is determined based on registration details; additional verification may be required.
  • Users must resolve personal disputes independently, as Maileditor LTD does not mediate.

GDPR Compliance

Users have the right to:

  • Request a copy of their personal data.
  • Edit, update, or delete personal information.
  • Exercise their "right to be forgotten."

Official support is provided exclusively in English.

6. User Obligations & Restrictions

6.1 Intellectual Property & Software Use

  • Users must not interfere with Service software or violate intellectual property rights.
  • Maileditor LTD retains full ownership of Maileditor Templates, which Users may modify but not resell or transfer.
  • When using images from other platforms, please review and adhere to their terms of use. Users are solely responsible for ensuring that any assets used do not violate third-party terms, and should avoid using anything with Maileditor that infringes upon those terms.
  • User-created emails and templates remain the User's property.

6.2 Prohibited Content & Activities

Users must not distribute content that:

  • Encourages violence or physical harm.
  • Promotes hate speech based on race, gender, religion, or other protected categories.
  • Violates anti-spam policies, including Spamhaus regulations.

6.3 Payment & Subscription Responsibilities

  • Paid Users must maintain valid payment details.
  • Payments must be updated before expiration to prevent Service disruption.
  • Users confirm they have the legal right to use their payment method.

6.4 Compliance with Legal Regulations

Users must ensure compliance with applicable laws, including:

  • General Data Protection Regulation (GDPR)
  • Children's Online Privacy Protection Act (COPPA)

Maileditor LTD is not liable for industry-specific compliance requirements unless explicitly stated.

6.5 Software & Security Restrictions

Users may NOT:

  • Reverse-engineer, decompile, or access the software source code.
  • Modify, copy, or distribute the software without authorization.
  • Bypass security features or remove proprietary labels.
  • Use the software for spam or bulk email distribution.
  • Abuse the "Send Test" feature, which is limited in use.
  • Send test emails to personal addresses (e.g., [email protected]); only business emails (e.g., [email protected]) are allowed.
  • Transmit unlawful, harmful, or defamatory content.
  • Upload copyrighted material without authorization.

7. Account & Data Deletion

Users acknowledge that:

  • Their Account and data may be permanently deleted under certain conditions.
  • They must provide documentation for dispute resolution.

By accessing the Service, Users agree to these Terms and all future amendments.

8. Plans and Payments

8.1 Free Plans

Users on free plans must retain the footer badge indicating the product was created using Maileditor LTD. This badge cannot be removed, hidden, or altered. To remove branding, Users must upgrade to a paid subscription. By using a free plan, you agree to maintain this branding.

But for only editing external html templates and export will not add the badge.

8.2 Purchases

If you make a purchase through our Service, you may need to provide:

  • Billing details, including your billing address.
  • Payment information, such as your credit card number and expiration date.

By providing this information, you:

  • Confirm that all details are accurate and complete.
  • Authorize Maileditor LTD to share your details with third-party payment processors, subject to our Privacy Policy.
  • Warrant that you have the legal right to use the provided payment method.

We reserve the right to refuse or cancel orders due to:

  • Product or service unavailability.
  • Pricing or description errors.
  • Payment fraud or suspected illegal transactions.

8.3 Payment Procedure

  • Subscription rates are listed in the Pricing section of our Website and may change periodically.
  • Billing occurs monthly on the same date each month (or the nearest available date).
  • If the User exceeds the plan limit, they must upgrade to a higher-cost plan before the next Payment Date.

8.4 Plan Downgrades & Upgrades

  • Users on the FREE plan who exceed its limits can return to the FREE plan by reducing their usage to match the plan's limits.
  • Users upgrading to a paid plan may cancel at any time via the Billing section, after which their plan will downgrade to the FREE plan at the end of the billing cycle.

8.5 Recurring Payments & Payment Failures

  • Paid Users must keep their payment details updated.
  • By subscribing, Users agree to automatic recurring payments (monthly or annually).
  • If a payment fails, we will attempt to contact the User and may temporarily suspend the Account until payment is processed.

8.7 Paid Plugin Usage

  • Paid plugins require continuous payments while active.
  • Plugin billing periods may differ from regular subscription cycles.
  • Some plugins require full pre-payment for the entire usage period.

Maileditor LTD reserves the right to modify pricing plans and notify Users via email or Website updates.

9. Returns and Refunds Policy

At Maileditor, we strive to provide high-quality digital products. We offer refunds for digital purchases within 25 days of the original purchase date. However, recurring subscription payments are non-refundable.

9.1 Refund Eligibility

A refund will be issued only if:

  • Not delivered - You are unable to use the product after purchase, or purchase was not successful;
  • Download issues - You are unable to download the templates due to technical issues.
  • Unused - You did not use the service after purchasing, was inactive, did not download any template or did not use any premium features.
  • Major defects - Includes website downtime, unexpected errors, or an inability to use the service due to technical issues on Maileditor's end. Scheduled maintenance downtimes will be communicated in advance, but refunds will not be provided for these periods.
  • The User has complied with all Terms, with no violations.

Refunds outside these conditions are at Maileditor LTD's discretion.

9.2 Non-Refundable Purchases

Refunds will not be provided for:

  • Purchases made at a discounted price.
  • Products with an available free/demo version.
  • Products that offer a live demo or trial period.

9.3 Third-Party Compatibility

We do not guarantee that our products will be compatible with third-party software unless explicitly stated on the product page. Refunds will not be issued due to incompatibility with unspecified third-party tools.

10. Disclaimer

Your use of the Service is at your own risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties, express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted performance.

Maileditor LTD, along with its subsidiaries, affiliates, and licensors, does not guarantee that:

  • The Service will operate without interruption, securely, or be available at all times.
  • Any errors or defects will be identified and corrected.
  • The Service will be free from viruses, malware, or other harmful components.
  • The results of using the Service will meet your all specific expectations or requirements.

By using the Service, you acknowledge and agree that Maileditor LTD is not liable for any technical issues, data loss, service interruptions, or security breaches beyond its reasonable control.

11. Changes to These Terms

Maileditor LTD reserves the right to modify, update, or replace these Terms at any time, at its sole discretion. If a revision is considered material, we will provide at least 30 days' notice before the new Terms take effect.

What constitutes a material change will be determined solely by Maileditor LTD.

By continuing to access or use the Service after any modifications become effective, you agree to be legally bound by the updated Terms. If you do not agree to the changes, you must discontinue use of the Service immediately.
